Facts of the case
Mr H* suffered an accident when his bike slipped as a result of ice on the road. It was a cold, December day and the ice was caused by a burst water pipe on the road-side leaking water onto the road.
The local water authority was attending to the leak however they had failed to close the road or adequately grit the road to reduce the risk of an accident occurring.
The water company argued that responsibility for the safety of the road remained with the local authority and that they should have gritted the road.
What action did Sorrymate take?
SorryMate’s specialist non-collision accident team pursued both the water company and local authority. Initially, both parties denied liability, each pointing the finger at each other.
Sorrymate issued Court proceedings against both potential Defendants. The case was won and we successfully secured damages for Mr H. This payment covered his injuries, loss of earnings, vehicle damage and damaged kit.
